Sean Sinclair Challenges Legislation Granting Mandatory Publication Bans

Sean Sinclair successfully challenged as unconstitutional recently passed legislation that makes it mandatory for the court to grant publications bans on the identities of youth victims of any crime.

Representing the media organizations in court, Sean said the judge’s ruling reinforced media’s role in ensuring the transparency of the court system and fundamental freedom of expression.

“The reality is that media are surrogates for the public.  In order to have an open and transparent court system, the media need to be able to properly report on what’s going on in the courtrooms,” Sinclair said.

“Any publication ban that’s going to impact on the press’s ability to report on what’s going on is going to affect the ability of individuals to understand what’s going on in the court system”.
