Successful decision in Marriage Commissioner Reference

The Court of Appeal for Saskatchewan has released its decision in the “Marriage Commissioners Reference”.

In the decision, the Honourable Mr. Justice Richards reasons that possible amendments which would have allowed marriage commissioners to refuse to solemnize same-sex marriages would have violated the equality rights of gay and lesbian individuals and “this violation would not be reasonable and justifiable within the meaning of s.1 of the Charter.  As a result, if put in place, either option would be unconstitutional and of no force or effect”.

Congratulations to Reynold Robertson, Q.C., Sean Sinclair and Candice Grant who were the appointed counsel arguing against the constitutional validity of the possible amendments to The Marriage Act, 1995.
