Jared D. Epp

As a partner at Robertson Stromberg LLP, Jared’s practice focuses on construction, commercial, and insurance law. He has appeared in courts throughout Saskatchewan, Alberta, British Columbia, and Manitoba. He is actively involved in all elements of the legal process, including arbitration and court-based proceedings. He also regularly assists parties in the procurement, contract drafting and execution of large construction projects, including in the mining, commercial and industrial sectors.

Jared acts for a wide variety of clients, including owners, consultants, contractors, suppliers, and insurers. He has appeared many times in front of the Saskatchewan Court of Appeal, including on matters involving The Builders’ Lien Act, an insurer’s obligation to provide coverage, and matters involving priority disputes in the context of receivership proceedings.

Jared completed his Juris Doctor of Law degree at the University of Saskatchewan with Great Distinction after completing a BA in Psychology (also with Great Distinction). His studies included a minor in Crime, Law, and Justice Studies.

Jared won the Douglas A. Schmeiser Prize for highest academic achievement in Constitutional Law and was a member of the winning team for the Sopinka Cup, an annual moot court trial competition between law schools in Canada. He also won an individual award for best cross-examination at this event. During his time at the College, Jared also acted as a student editor of the Saskatchewan Law Review.

Jared is a member of the Saskatoon Construction Association and the Canadian Bar Association (CBA) as well as the past president of the Saskatchewan Trial Lawyers Association (STLA). He also is the past chair of CBA Saskatchewan’s Construction and Infrastructure branch as well as a past editor for CBA Saskatchewan’s quarterly publication, Bar Notes. Additionally, Jared has acted as the legal officer for the Saskatoon branch of Construction Specifications Canada.

Jared has written articles for STLA’s The Advocate, the CBA’s Bar Notes, and for the Public Legal Education Association. His work has also been published in the Saskatchewan Law Review, Claims Canada, and Construction Specifications Canada. Jared is also a co-author of The Builders’ Lien Manual, a textbook, published by the Law Society of Saskatchewan, that provides a comprehensive overview of the operation and meaning of Saskatchewan’s Builders’ Lien Act.

Jared also developed and currently teaches a fully accredited university course in Construction Law for the University of Saskatchewan.

Jared regularly presents on legal issues to community as well as to industry, including the Saskatoon Construction Association,  the Canadian Bar Association, the College of Law, and Construction Specifications Canada. His presentations have included topics such as The Builders’ Lien Act, insuring the construction project, bidding and tendering, and effective oral advocacy in the courtroom.

Some of the most recent significant cases that Jared has been involved with include:

  • Koh v. Atrium Mortgage Corporation, 2023 SKCA 45. Acting on behalf of a commercial lender, Jared successfully obtained a summary judgment, upheld on appeal, on personal guarantees against 9 different individuals worth more than $10 million.
  • Liquid Capital v. Mainline Industrial, 2019 SKCA 66.  Acting on behalf of a number of lien claimants, Jared successfully advanced a claim to holdback monies payable on a construction project, in a case involving insolvency, against a commercial factor and the Canadian Revenue Agency.
  • National Bank of Canada v. KNC Holdings Ltd., 2017 SKCA 57. Acting on behalf of a number of contractors, Jared challenged the priority position of a bank in an insolvency proceeding. KNC Holdings is now the leading decision in Saskatchewan in relation to builders’ lien claims in insolvency proceedings, particularly in the context of lien claims against oil and gas proceeds.
  • Thompson v. O’Hara, 2016 SKCA 83. Representing a Power of Attorney, Jared was successful in overturning a judgment that had ordered the Power of Attorney to return farm land alleged to have been purchased at below market value. Thompson is the first decision released by the Court of Appeal to substantively consider the new powers and provisions granted by The Powers of Attorney Act, 2002.
  • Scott v. Seier Estate, 2016 SKCA 76. Jared successfully represented the Executor of an estate in defending a Court of Queen’s Bench decision which dismissed a claim for dependent’s relief made against a multi-million dollar estate.
  • Morozoff v. Fitness Focus Health & Athletic Centre, 2015 SKQB 89. Jared successfully brought a summary judgment application on behalf of an insurer for dismissal of a claim. Morozoff is the first case in Saskatchewan in which an insurer successfully used a summary judgment application to dismiss a claim founded in occupier’s liability.
